Projet de décret relatif à la gestion quantitative de la ressource en eau et à la gestion des situations de crise liées à la sécheresse
Le projet de décret s’inscrit dans le contexte général d’événements et de rapports marquants relatifs à la gestion quantitative de l’eau, tant structurelle (gestion équilibrée et durable) que conjoncturelle (gestion des crises sécheresse) survenus depuis l’été 2017. Notamment, une communication interministérielle du 9 août 2017 appelle à la sobriété et la concertation, l’instruction du 7 mai 2019 suite au rapport de la cellule « Bisch » cadre la mise en place de projets de territoires sur la gestion de l’eau, les assises de l’eau séquence II consacrées au grand cycle de l’eau portent des engagements d’économies d’eau et de mises en œuvre de solutions fondées sur la nature, un rapport du CGEDD sur la sécheresse de 2019 et un sur les organismes uniques de gestion collective font des recommandations d’améliorations sur ces sujets. Enfin, plusieurs autorisations uniques de prélèvement ont été annulées en 2019 entraînant des souhaits de sécurisation juridique.
Dans ce contexte global, le présent projet de décret propose :
- d’encadrer la réalisation d’études d’évaluation des volumes prélevables dans les milieux naturels en période de basses eaux pour les usages anthropiques, sur les bassins en déséquilibre sur cette période,
- de renforcer l’encadrement et l’harmonisation à l’échelle du bassin et du département de la gestion de crise sécheresse dans les zones d’alerte et la célérité des décisions afin de renforcer l’efficacité et l’équité de celles-ci,
- de simplifier le classement de bassins en zone de répartition des eaux où des exigences renforcées dans la gestion des prélèvements sont applicables en unifiant la compétence au seul niveau du préfet coordonnateur de bassin,
- de renforcer la compétence du préfet coordonnateur de bassin en matière de gestion quantitative de la ressource en eau et notamment en matière de cadrage et de portage des études d’évaluation des volumes prélevables et d’approbation de leur répartition entre usages,
- d’améliorer le contenu du dossier de demande et de l’arrêté d’autorisation unique de prélèvement prévue pour la gestion collective de l’irrigation en répondant aux insuffisances et incompréhensions signalées par le juge
- de renforcer le statut de prescriptions annuelles du plan annuel de répartition qui fixe précisément à chaque irrigant le volume auquel il a droit et les modalités de prélèvement et d’en accélérer l’établissement de manière à coller à la temporalité des campagnes d’irrigation
Il définit également une compétence de participation à la gestion quantitative de l’eau pour le service public d’eau et d’assainissement du bloc communal en application de la loi engagement et proximité.
